A building permit is the official authorization from the relevant municipality that must be obtained before a building can legally be constructed. Buildings erected without or in violation of a permit can give rise to serious legal and financial problems later on. Managing the process correctly from the outset is therefore critically important.

Zoning Status Certificate

The process begins with obtaining a zoning status certificate from the municipality to which the property belongs. This document sets out the zoning district, construction density (site and floor area ratios), building height limits and setback requirements. Entering the design process without knowing the zoning conditions can necessitate fundamental revisions to the project at a later stage.

Required Documents and Technical Projects

The technical projects required for a permit application include (as stipulated by Zoning Law No. 3194):

  • Architectural project (site plan, floor plans, sections, elevations)
  • Structural (reinforced concrete) project and calculations
  • Geotechnical investigation report
  • Mechanical installation project (heating, ventilation, plumbing)
  • Electrical and low-current installation project
  • Energy Performance Certificate (EPC)

All these projects must be mutually consistent and compliant with applicable regulations.

Building Inspection Process

Under the mandatory building inspection system introduced in Turkey in 2000, a contract with an approved inspection firm is compulsory. The building inspection firm is responsible for project review at the design stage and site supervision during construction. This oversight ensures that the building is constructed in conformity with the approved project and to a safe standard.

After the Permit: Occupancy Certificate

Once construction is complete, an application is made for an occupancy certificate. Following an on-site inspection by municipal inspectors and submission of all required documents, the occupancy certificate is issued.
